Should your wife or other dependant family members not be European Nationals, it is important for you to apply for this visa on their behalf before they come to settle in the UK. You must have the right to live and work in the UK before they come. This visa will be granted for 5 years, after which the dependant can apply for residence in the UK subject to certain requirements being met.

Dos & Don’ts

Do's

  • Make sure that you have applied for this visa before your dependant travels;
  • Under European Community Law, your family includes;
  • Your husband or wife;
  • Your or your husband's or wife's children or grandchildren (if they are under 21 years of age or if they are over 21 and dependent on you);
  • Dependent relatives, for example your husband's or wife's parents or grandparents;
  • If you are a student, only your husband or wife and your dependent children can join you ;
  • Non-EEA family members must get an EEA family permit before they travel to the UK if they are visa nationals, or if they are coming to live with you permanently or on a long-term basis;

Don’t

  • This application cannot be made in the UK;
  • Your other relatives, such as brothers, sisters, cousins etc., do not have an automatic right to live in the UK with you;
  • However the Home Office will consider applications for your other relatives to join you if you are working in the UK and They are dependent upon you They were living with you before you came to the UK;
  • If they try to enter the UK for this purpose without an EEA family permit we may refuse them.
