Work Permit Settler

If you are holding a Work Permit and have been working on a continuous basis on a Work Permit issued to you before April 2007 you and your dependants will be allowed to apply for settlement, as the main applicant you will have to prove that you have retained full time employment, with your sponsored employers, if you have moved employment you must prove that you work permit was formally transferred to the new employers throughout the 5 years qualifying period.

Settlement may be granted to those who have completed 5 years here in this category, if it is specifically applied for, however; if a work permit holder, who has been in the UK applies for a limited period, the application should not be treated as one for settlement. If you have obtained an Employment Certificate under the Tier 2 Points Based System you may qualify for settlement. You will have to wait for further details on the Home Office policy to define whether or not settlement will be issued under Tier 4 of the Points Based System.

You will have to pass the “Living in the UK” test to qualify for settlement.
